USERS: Access and use of the EGUREN UGARTE websites confers the status of USER, who accepts, on entering and/or using the site, the General Conditions detailed in this document. These Conditions are applied independently from any General Terms and Conditions of Contract that may be mandatory.
USE OF THE SITE: The EGUREN UGARTE Site provides access over the Internet to a great deal of information, services, programmes or data (hereinafter, "content") belonging to EGUREN UGARTE or its licensees. The USER accepts responsibility for using the Site. This responsibility includes registering to access certain services or content. The USER is responsible for providing true and legal information when registering. As a consequence of registering, the USER may receive a password for which he is responsible, and which he undertakes to use responsibly and keep confidential. The USER agrees to make responsible use of the content and services (for example chat services, forums or news groups) that EGUREN UGARTE offers through its Site and undertakes not to use them to take part in activities including, but not limited to, any of the following (i) illicit or illegal activities, or those contrary to good faith and public order; (ii) distribution of racist, xenophobic, pornographic and illegal content or propaganda; justification of terrorism or violation of human rights; (iii) the causing of damage to physical or computer systems belonging to EGUREN UGARTE, its suppliers or third parties or disseminate computer virus or any other physical or logical systems capable of causing the abovementioned damage; (iv) trying to access, and eventually use mail accounts of other users or modify and manipulate their messages. EGUREN UGARTE reserves the right to remove all comments and contributions that violate personal dignity; express discrimination, xenophobia or racism; are pornographic, harmful to the young or to children; incite public disorder or violence, or, in EGUREN UGARTE's opinion, are not suitable for publication. In any event, EGUREN UGARTE will not be liable for the opinions expressed by users in chats, forums or other means of participation.
DATA PROTECTION: EGUREN UGARTE complies with Organic Law 15/1999 dated 13th December on the Protection of Personal Information, Royal Decree 1720/2007 of the 21st December approving the Regulations of the Organic Law and any other current legislation, and is vigilant to guarantee correct usage and handling of users' personal information. To this end, on each form used for compiling information necessary for the services the USER may request from EGUREN UGARTE, the USER will be informed of the terms and acceptance of the conditions of data policy in each case, indicating the file created, the address of the person responsible, the USER's legal right to access, modification, cancellation or opposition, the object of the data handled and, if applicable, third parties to which the personal information is communicated. INTELLECTUAL AND INDUSTRIAL PROPERTY: EGUREN UGARTE on its own behalf or as a concessionaire, is the owner of all intellectual and industrial property rights of its web pages, as well as all elements they contain (that is, images, sounds, audio, software or texts; brands, logos, colour combinations, structure and design, selection of materials employed, computer programmes required for the page's functionalities, access and use, etc.), belonging to EGUREN UGARTE or its licensors. All rights reserved. Pursuant to articles 8 and 32.1, paragraph 2 of the Intellectual Property Law, the reproduction, distribution, public communication and making available of the whole or part of the site's contents, for commercial gain, in any media and by any technical means, without EGUREN UGARTE's authorisation, are prohibited. The USER undertakes to respect the Intellectual and Industrial Property rights of EGUREN UGARTE. The USER may visualise the site's content, print it and store it on a hard drive or other physical storage device providing the copy is exclusively for personal and private use. The USER must not erase, alter, elude or manipulate any protection device or security system installed on the EGUREN UGARTE site.
LIMITS OF THE GUARANTEE AND RESPONSIBILITY: EGUREN UGARTE shall under no circumstance be liable in any event, for any loss or damages caused by, amongst others: errors or omissions in the content, failure of the site or the transmission of virus or other malicious content, although all the necessary protective measures have been taken against them.
MODIFICATIONS: EGUREN UGARTE reserves the right to make any changes considered necessary to the site and may change, remove or add content and services that the site provides or change their appearance or location on the Site.
USE OF COOKIES: EGUREN UGARTE may use cookies to personalise and facilitate the USER's navigation on the SITE. Cookies are only associated with an anonymous user and his computer and do not contain any reference allowing the deduction of any personal information on the USER. The USER can configure his computer to notify him of and reject the installation of cookies sent by EGUREN UGARTE, without limiting his access to the Content.
LINKS: In the event of the Site containing links or hyperlinks to other third party Internet sites, EGUREN UGARTE will have no control over the said sites or their content. Under no circumstance shall EGUREN UGARTE be held liable for the contents of linked third-party sites, nor guarantee their availability, quality, reliability, accuracy, veracity, validity or constitutionality of any material or information they —or any other Internet site— contain. Further, the inclusion of any external link does not imply any kind of association, merger, or participation in any company linked to.
RIGHT OF EXCLUSION: EGUREN UGARTE reserves the right to deny entry to the Site and the services it provides without prior warning, on its own account, or on that of others, to those users who fail to respect these General Terms of Use.
GENERAL: EGUREN UGARTE will prosecute users violating these conditions or making malicious use of the site, and will employ all pertinent civil and criminal actions.
MODIFICATION OF THE CURRENT TERMS AND THEIR DURATION: EGUREN UGARTE may modify at any time the terms stated herein, publishing them in this form. The validity of these terms is subject to their publication and they shall remain valid until modified by other, duly published, terms and conditions.
RELEVANT LEGISLATION AND FORUM: The relationship between EGUREN UGARTE and the USER shall be governed by Spanish law and any dispute shall be submitted to the Courts and tribunals at Vitoria-Gasteiz.
